1. Acceptance of Terms
By downloading, installing, or using the My Padi mobile application or any associated website (collectively, the “Platform”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Platform. These Terms form a legally binding agreement between you and My Padi (“we”, “us”, or “our”), a service operated in Cameroon.
2. Eligibility
You must be at least 18 years of age to create an account and use the Platform. By using My Padi, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.
3. Platform Overview
My Padi is a marketplace that connects clients seeking personal assistance services with verified local service providers (“Padis”). Services available on the Platform include, but are not limited to: grocery shopping, home moving, professional cleaning, and home cooking.
My Padi acts solely as an intermediary. We do not directly employ service providers and are not responsible for the quality, safety, or outcome of any service performed by a Padi. All providers are independent contractors.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@mypadi.cm if you suspect any unauthorized use of your account.
We reserve the right to suspend or terminate any account that we believe, in our sole discretion, violates these Terms or is being used fraudulently.
5. Provider Verification
All Padi service providers are subject to a physical audit process before being approved on the Platform. This includes in-person verification of their residence, identity documents, and relevant assets. While we take reasonable steps to verify providers, My Padi does not guarantee the accuracy of any provider information and makes no warranties regarding the conduct of providers once verified.
6. Payments and Escrow
All payments on the Platform are processed through our secure escrow system. When a client places an order, the agreed amount is held in escrow. Funds are released to the provider only after the client confirms that the service has been completed to their satisfaction.
Supported payment methods include MTN Mobile Money, Orange Money, Fapshi, and bank transfer for eligible amounts. My Padi charges a service fee on each completed transaction, which will be clearly displayed before confirmation.
Clients may not circumvent the Platform's escrow by making off-platform payments to providers. Doing so voids any dispute protection provided by My Padi.
7. Cancellations and Refunds
Cancellation and refund eligibility depends on the stage of the order:
- Orders cancelled before a provider accepts them are fully refunded.
- Orders cancelled after acceptance but before work begins may be subject to a partial fee.
- Orders cancelled after work has commenced are non-refundable except where a dispute is upheld.
Refunds are processed back to the original payment method within 3–7 business days.
8. Disputes
If you have a dispute with a provider, you must report it through the in-app dispute resolution feature within 24 hours of order completion. My Padi will review the evidence provided by both parties and issue a final decision within 5 business days. My Padi's decision in all disputes is final and binding.
9. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable Cameroonian law.
- Post false, misleading, or defamatory content about any user or provider.
- Attempt to manipulate ratings or reviews.
- Solicit or accept payments from clients or providers outside of the Platform.
- Impersonate any person or entity.
- Attempt to gain unauthorized access to any part of the Platform or its infrastructure.
- Use the Platform to harass, threaten, or discriminate against any other user.
Violations may result in immediate account termination and legal action where applicable.
10. Limitation of Liability
To the fullest extent permitted by law, My Padi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including any damages arising from the conduct of service providers.
Our total liability to you for any claim arising under these Terms shall not exceed the total amount you paid through the Platform in the 30 days preceding the event giving rise to the claim.
11. Intellectual Property
All content, trademarks, logos, and intellectual property on the Platform are the exclusive property of My Padi or its licensors. You may not reproduce, distribute, or create derivative works from any Platform content without our prior written consent.
12. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to the collection and use of your information as described in our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and notify you via the app or email. Continued use of the Platform after any changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Cameroon. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Bamenda, Cameroon.
